Filing a claim in bankruptcy proceedings: key steps

Bankruptcy proceedings provide a legal framework to settle the debts of companies or individuals who are no longer able to meet their financial obligations. The process takes place before a district court. In accordance with Article 243 of the Financial Operations, Insolvency Proceedings and Compulsory Dissolution Act (ZFPPIPP), the court publishes a notice of the initiation of bankruptcy proceedings on the AJPES website. This serves to notify creditors that bankruptcy proceedings have been opened against the debtor.

Notice of the initiation of bankruptcy proceedings

The notice includes:

  1. Details of the court handling the case and the case number.
  2. Information under the first paragraph of Article 242 of the Act, i.e., identification details of the bankrupt debtor and the court’s decision to initiate the proceedings.
  3. Identification details of the insolvency trustee.
  4. An invitation to creditors to file their claims and any secured or separation claims within three months from publication of the notice by submitting an application in duplicate. It also includes an explanation of the legal consequences of missing this deadline.
  5. The date of publication of the notice.

Filing a creditor’s claim

The filing must include:

  1. A specific request for the claim to be recognized in the proceedings.
  2. A description of the facts supporting the claim and evidence thereof.

Timely filing is crucial for protecting a creditor’s rights. By filing within the prescribed period, the creditor gains the right to participate in the insolvency proceedings and the possibility of repayment from any assets in the bankruptcy estate.

The insolvency trustee must review each timely filed claim and either recognize it or contest it. If the claim does not include a description of the facts and supporting evidence, the creditor bears the costs of any proceedings to establish the existence of the claim, should the trustee contest it.

Claims on which the trustee has decided are published on the AJPES website as the basic list of examined claims.
