Emergency Law introduces temporary permits for foreigners

On July 25, 2024, the Act on Measures to Optimize Certain Procedures at Administrative Units (Official Gazette of the Republic of Slovenia, No. 62/24; hereinafter referred to as the emergency law) came into effect. The key solutions of this law include the regulation of the temporary permit process for foreigners. This process will allow them to work and reside in Slovenia while the procedure at the administrative unit continues until a final decision is made. Additionally, the law eliminates local jurisdiction for administrative units in matters concerning foreigners and in procedures for registering individuals’ residences.

Legal work and residence

Articles 24 to 26 of the emergency law permit foreigners, nationals of third countries, to reside and work legally in the Republic of Slovenia. This is based on a certificate of application for a single permit for residence and work issued by the administrative unit, along with an approval or work permit issued by the Employment Service of Slovenia. These permits are valid while the procedure at the administrative unit continues until a final decision is reached. This regulation will apply to all applications that have already been submitted or will be submitted to the competent administrative unit by September 30, 2024. It applies only to foreign workers who are citizens of visa-free countries.

The competent administrative units further clarify the following:

  • Foreigners whose work and residence permit process is conducted under the emergency law can submit their fingerprints at the administrative unit in Slovenia where the process is ongoing. They can also collect a single permit for work and residence at the same administrative unit once the process is complete.
  • If the applicant (foreigner/employee or employer) submits an application for a single permit for work and residence under the emergency law, this must be marked on the application. Only then can they benefit from the advantages provided by this emergency law.
